Terms of Use Caraplace
This translation is provided for ease of understanding. The German version is legally binding.
1. Scope
1.1 These Terms of Use govern the use of the platform Caraplace (caraplace.ch), operated by Manuel Meyer, sole proprietorship, Bleumatthalde 3, 5073 Gipf-Oberfrick, Switzerland (“Caraplace”, “we”).
1.2 They apply to all persons who use Caraplace — as Providers (persons who list a parking or storage space) and as Seekers (persons who view listings and contact Providers).
1.3 By creating an account, placing a listing or submitting a contact request, you accept these Terms of Use. Deviating terms and conditions of users shall not apply.
2. Services of Caraplace
2.1 Caraplace is an intermediary platform: Providers publish listings for parking and storage spaces for motorhomes, caravans, trailers and similar vehicles; Seekers can browse these listings and contact Providers directly.
2.2 Caraplace is not a party to any contracts concluded between Providers and Seekers. We do not broker contracts in the legal sense, do not process rental or usage payments, give no assurances regarding spaces, prices or persons, and do not assume any performance of contracts.
2.3 We do not systematically verify listings for accuracy, lawfulness or availability. Seekers are themselves responsible for verifying a space and the contractual terms before concluding a contract or making any payments.
2.4 We endeavour to ensure high availability of the platform but do not owe any specific level of availability. Maintenance work, further development and malfunctions may lead to interruptions. We may change, extend or discontinue functions at any time.
3. Account
3.1 An account (e-mail address and password) is required to place and manage listings. Seekers do not need an account.
3.2 An account may only be opened by natural persons who are of legal age and have legal capacity, or by persons authorised to represent a legal entity. One account per person or business is intended.
3.3 The information provided upon registration must be true and up to date. Changes must be updated in the account.
3.4 You shall keep your login credentials confidential and shall not disclose them to third parties. Actions carried out via your account are attributed to you. If you suspect misuse, please inform us immediately at info@caraplace.ch.
3.5 You may delete your account at any time in the account settings or by notifying us at info@caraplace.ch. Fees already paid will not be refunded as a result (clause 6.6).
4. Rules for Listings
4.1 Truthfulness and currency. Information regarding the space, location, size, facilities, availability and price must be true, complete and up to date. If a space is no longer available, deactivate the listing.
4.2 Entitlement. You may only list spaces over which you are yourself entitled to dispose (as owner, as tenant with a right to sublet, or as an expressly authorised person). Upon request, you shall provide proof of your entitlement.
4.3 One listing per space. Duplicate or multiple listings for the same space are not permitted. In the case of several similar spaces at the same location, one listing stating the number of spaces shall be created.
4.4 Permitted content. Listings may only contain offers for parking or storage spaces and services directly related thereto. In particular, the following are not permitted: advertising for other products or services, links to third-party platforms with a similar purpose, misleading or unlawful content, discrimination, harassment, content that infringes the rights of third parties.
4.5 Contact details. You may only provide your own contact details or those which you are expressly authorised to publish. Contact details of third parties (e.g. neighbours, property management companies, other Providers) without their consent are prohibited.
4.6 Images. Uploaded images must show the listed space and must not infringe the rights of third parties (copyrights, personality rights, trade marks). You warrant that you have created the images yourself or hold the necessary rights and that any identifiable persons depicted have given their consent. Images showing identifiable number plates, persons or third-party property are to be avoided. No images from the internet without a licence.
4.7 Prices. The prices stated must correspond to the prices actually charged; hidden surcharges are not permitted.
4.8 Statutory requirements. The Provider alone is responsible for the lawfulness of the letting (e.g. zoning compliance, permits, tenancy law, taxes).
4.9 Prohibition of automated use. The automated extraction (scraping) of listings, the mass creation of listings or requests, and interference with the technical infrastructure are prohibited.
5. Rights to Content
5.1 The rights to the texts and images created by you remain with you or the respective rights holders.
5.2 By uploading, you grant Caraplace a non-exclusive, royalty-free, worldwide right, limited in time to the duration of publication plus a reasonable subsequent period, to store, reproduce, technically adapt (e.g. resize, crop, convert formats, remove metadata), make publicly available and display the content for the purpose of operating the platform, in overviews, map views, previews, search results as well as in search engine and social media previews.
5.3 After a listing has been deleted, we remove the content from the platform within a reasonable period; copies in backups and held by third parties (e.g. search engine caches) may temporarily persist.
5.4 You shall indemnify Caraplace against claims by third parties based on a breach of clause 4 or 5 by your content, including reasonable costs of legal defence.
6. Fees and Payment
6.1 Placing listings is currently free of charge. Use as a Seeker is and remains free of charge.
6.2 We reserve the right to charge a fee per listing in the future for placing or renewing listings. The introduction of or any change to fees will be announced on the platform and by e-mail to registered Providers at least 30 days in advance. Listings already published will not retroactively become subject to a fee for their current term.
6.3 Where a fee applies, it will be clearly displayed before purchase, stating the amount in Swiss francs, the term of the listing and any applicable value added tax. The contract for the paid listing is concluded when you complete the ordering process by clicking the payment button; you will immediately receive a confirmation by e-mail. Before completing the order, you can review and correct your entries.
6.4 Payment is made via the payment service provider Stripe (credit card/debit card, TWINT). Stripe’s terms and conditions for the payment process apply in addition. We do not store complete card details.
6.5 The listing will be published or renewed after successful payment.
6.6 No refund. As the service (publication of the listing) is rendered immediately upon activation, there is no entitlement to a refund after publication, including in the event of early deactivation by you, lack of success in finding a counterparty, or suspension due to a breach of these Terms. Mandatory statutory claims remain reserved. If publication fails for technical reasons for which we are responsible, we will refund the fee or subsequently publish the listing.
6.7 There is no statutory right of withdrawal for contracts concluded online under Swiss law; no voluntary right of withdrawal is granted.
7. Term and Deactivation of Listings
7.1 Listings have a term specified when they are placed. Upon expiry, they are automatically deactivated and are no longer publicly visible. You will be informed by e-mail beforehand and can renew the listing.
7.2 You may deactivate, edit or delete listings yourself at any time.
7.3 Deactivated listings remain stored in your account for 6 months and are deleted thereafter.
8. Moderation, Reports, Suspension
8.1 We are not obliged to review content in advance. However, we reserve the right to review listings on a random basis or on the basis of reports received.
8.2 Any person may report content that infringes rights or breaches the rules to us at info@caraplace.ch (with a link and reasons). We review reports promptly and inform the Provider concerned where appropriate.
8.3 We may adapt, deactivate or delete listings in whole or in part, and temporarily suspend or permanently close accounts, where there is reasonable suspicion of a breach of these Terms of Use, of applicable law or of the rights of third parties, where fraud is suspected, upon official order, or where this is necessary to protect the platform or other users. Where possible, we will inform you of the reason and give you the opportunity to respond.
8.4 In the event of suspension due to a breach, there is no entitlement to a refund of fees paid.
9. Obligations of Seekers
9.1 Contact details from listings may only be used to make contact regarding the listed space — not for advertising, disclosure or collection.
9.2 Contact requests must be genuine. Mass, automated or harassing requests are prohibited.
9.3 Seekers are themselves responsible for verifying the Provider and the space and for the terms of their contract with the Provider. Do not make any deposits without having verified the space and the Provider. Please report suspicious listings to info@caraplace.ch.
10. Liability
10.1 Third-party content. Listings, images, contact details and requests originate from users. Caraplace gives no warranty as to their accuracy, completeness, currency, lawfulness or quality and is not liable for damage arising from reliance on such content or from contracts between users. Caraplace is not responsible for disputes between Providers and Seekers.
10.2 Availability and loss of data. Caraplace is not liable for damage resulting from interruptions, malfunctions, loss of data, delayed or failed delivery of requests or e-mails, unless this is attributable to gross negligence or intent on the part of Caraplace. Back up important content yourself.
10.3 Limitation of liability. To the extent permitted by law, Caraplace’s liability for slight negligence as well as for indirect damage, consequential damage and loss of profit is excluded. In the case of paid listings, liability is — to the extent permitted by law — limited to the fee paid for the listing concerned. Liability for intent and gross negligence as well as for personal injury remains unaffected.
10.4 External services. Map data and geocoding are provided by OpenStreetMap; payment processing is carried out by Stripe. We give no warranty as to the availability and accuracy of these third-party services.
11. Data Protection
The processing of personal data is described in our Privacy Policy; it forms an integral part of these Terms of Use. Providers who receive personal data of Seekers via contact requests are themselves responsible for processing such data lawfully and may only use it to respond to the request.
12. Amendments to the Terms of Use
12.1 We may amend these Terms of Use, in particular in the event of changes to the services, the fees or the legal situation.
12.2 We will inform registered Providers by e-mail at least 30 days before material amendments enter into force. If you do not object before the amendments enter into force, or if you continue to use the platform thereafter, the new Terms shall be deemed accepted. In the event of an objection, we may close the account as of the date on which the amendments enter into force; for current paid listings, the previous Terms shall apply until their expiry.
12.3 For Seekers, the version published on caraplace.ch at the relevant time applies.
13. Final Provisions
13.1 Applicable law. Swiss law applies, to the exclusion of the conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).
13.2 Place of jurisdiction. The place of jurisdiction is the domicile or registered office of the operator (Gipf-Oberfrick, Canton of Aargau). Mandatory statutory places of jurisdiction remain reserved, in particular for consumers (Art. 32 of the Swiss Civil Procedure Code (ZPO)), who may also bring or be subject to proceedings at their place of domicile.
13.3 Severability clause. Should any provision of these Terms of Use be invalid, the validity of the remaining provisions shall remain unaffected; the invalid provision shall be replaced by a valid provision that comes closest to its economic purpose.
